NAME: The Constitution of Association of Property Agents of Nigeria (APAN). We, members of the Association of Property Agents of Nigeria (APAN) do give to ourselves the following constitution to bind ourselves together as Agents, Property Owners, Property Developers and Traders.
This bye-law shall be supreme and remain irrevocable; therefore any Resolution and decision contrary to the tenets and provisions of this constitution/ law shall be null and void to the extent of its inconsistency.
The Motto of the Association of Property Agents of Nigeria APAN shall be making property Ownership accessible.
SECTION THREE- ADDRESS:
The Registered office of the Association shall be situated at #115 Jubilee Road Aba- Nigeria or such other place as may be decided by the National Delegates Committee/Conference. Any change affecting the Registered office shall be notified/communicated to the appropriate Authority(ies) as prescribed and in the process stipulated by law.
The official emblem of the Association shall be the designation of building with some infrastructures or as may be decided by the National Executive Committee, Council or Conference of the Association (APAN). No chapter or Zones shall design anything other than the one so provided by the central office or government including the issues of stickers, identity card, Calendars and other programmes without the approval of the central body.
The National Executive Council, Committee or Conference of APAN shall be responsible for designating and establishing an official journal of the Association called property Digest. The interest of the Association shall always be represented in the said Journal, Magazine or Newsprint. It shall be the duty of the Executive aforementioned to see how it shall be properly worked out towards ensuring that ideas and belief in the publication is successfully carried out.
The Association can go into partnership with any person, group of persons or corporate body towards ensuring the implementation of the publication of the Journal with a defined and a good term of operation worked out and agreed with the Executive.
AIMS AND OBJECTIVES
1.To educate our members on good Agency relations
2.To help in sanitizing the Agency/Property Development Sector
3.To contribute collectively towards better Agency Practices
4.To provide a forum for exchange of ideas and views for the improvement and Development of members and property development.
5.To organize seminars and workshops aimed at improving members and public awareness of the business of Agency and Property Development.
6.To promote the activities of member agents.
7.To serve as a link between her members and the general public towards identifying and flushing out quarks from the Agency business.
8.To educate, enlighten and train her members on the laws, regulations and scope of operation in the activities and nature of the job of an Agent, as provided by law through seminars and workshops.
9.To serve as a forum where people of like-minds are allowed to interact and disseminate information on those who needs their services/assistants and jobs.
10.To protect her members generally, especially as relating to their legal activities/service.
11.To perform such other functions and objectives agreed by her members or given by any government, body, agency or arm with a view of enhancing or attaining the above goals, objectives and aspirations.
SECTION 1: CONSTITUTION AND GOVERNMENT
The following offices/officers shall form the National Executive Committee of the Association of Property Agents of Nigeria(APAN)
3.Vice Presidents- Covering the various zones of the country namely: South-South, South-West, South-East, North-East, North Central and North East
5.Assistant Secretary General
8.Public Relations Officer
9.Social organizing Secretary
11.Any other person(s) appointed by the Executive or President
12.Administrative Secretary (Private).
The National Executive Council of APAN shall consist of the following: President, Vice Presidents, Secretary, Assistant Secretary, All members of the National Executive Committee and the State Chairman and Secretaries including those invited to represent at any particular point in time.
ASSOCIATION OF PROPERTY AGENTS OF NIGERIA (APAN)
SECTION TWO: DUTIES OF NATIONAL OFFICERS
1. THE PRESIDENT:
a.The President shall be elected in a properly conducted election by a secret ballot at an agreed period and date fixed by National Executive Committee.
b. Preside at all meetings of the Association
c.Run the day to day affairs of the Association as an Executive President
d.Represent the Association whenever or wherever the need arise.
e.See that the vision, aim, objectives of the Association are carried out effectively and efficiently.
f.Sign and decide programmes and monetary transaction of the Association.
g.He shall offer useful advice to the National Executive Council or any other body within the Association as regards the funds of the Association.
h.He shall keep a monthly imprest account of Twenty Thousand Naira (#20,000,00) or any other amount agreed by the National Executive Committee for the proper conduct of the Association Activities.
i.The President so elected shall serve for a period of three years with an opportunity of re-contesting such position.
j.Where there is no possibility of an election within the specified period the person acting as the President shall continue to serve as the President for a period of six months pending the election of a President as provided in this constitution.
k.The President is Accountable to the Trustees of the Association and the Executive Committee at the National level and has the power to call to order local branch Executive(s) including suspending same in consultation with the National Executive Committee
2.THE DEPUTY PRESIDENT:
He shall deputize for the President.
He shall be assigned other responsibilities
3.THE VICE PRESIDENTS
a.There shall be six Vice presidents who shall come from the six geo-political zones of the country
b.Any of the Vice-President shall deputize for the President and act or preside in his absence and of the Deputy President.
c.Receive all visitors to the Association of Property Agents of Nigeria (APAN)
d.Perform all other functions as may be assigned to them by the office of the President or Executive Committee.
e.They shall coordinate the Activities of the Association (in the zone).
4.THE NATIONAL SECRETARY-GENERAL
a.The Secretary general shall be responsible for the proper recording of the proceedings of every meeting.
b.Deal with all correspondence in consultation with the President or the National Executive Committee.
c.Convene all meetings after consulting with the president or the National Executive Committee.
d.Perform all other duties and functions, which the president may assign to him from time to time for the furtherance of the Associations aims and objectives.
5.NATIONAL ASSISTANT SECRETARY GENERAL
a.The Assistant Secretary General shall deputize for the Secretary or act in his absence.
b.Perform all other duties and functions that may be assigned to him from time to time by the President, Secretary-General and National Executive Committee.
a.The National Treasurer shall among other acts, collect all monies accruing to the Association (APAN) in conjunction with the office of the Financial Secretary and President.
b.Ensuring that all such monies are paid into the appropriate fund or institution/Account.
c.Ensuring that proper receipts are issued in respect of such monies.
d1.Keep an imprest Account to be determined by the National executive Committee who shall through the President approve money for the running of the activities of the Association.
d2.Be a signatory to the account of the Association.
e.Perform other incidental functions that may be assigned to him/her from time to time by the President or executive Committee.
f.The President and any other officer, treasurer or Financial Secretary may withdraw money from the Account.
7.NATIONAL FINANCIAL SECRETARY
a.The National Financial Secretary shall keep an account of the income and expenditure of the Association of Property Agents of Nigeria (APAN).
b1.Issue a financial report on the income and expenditure including activities of his office with the staff(s) in charge of properties and ventures engaged by the Association.
b2.Be a signatory to the account of the association.
c.Audit all financial records of the Association in consultation with Auditors internal or external.
d.The National Financial Secretary shall in consultation with Financial Secretaries of the chapters prepare budget and accounts of the Association.
e.Perform other functions or duties that may be assigned to him/her from time to time.
